Include: (a) identification of the copyrighted work; (b) the exact URL of the allegedly infringing material on this site; (c) your full name, address, email and telephone number; (d) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law; and (e) a statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf. We will review valid notices promptly and remove or replace material where appropriate.
7. Editorial independence
All market reports, model coverage, rankings and articles on the Service are produced independently. Advertising may support the publication, while paid placements and sponsored content are clearly labelled and kept separate from editorial decisions. The opinions expressed in our articles are our own and do not represent the views of any company mentioned in the Service.
8. Third-party services
The Service may refer to websites or services that are not owned or controlled by EVWired. We have no control over, and assume no responsibility for, their content, accuracy, privacy policies or practices. You acknowledge and agree that EVWired shall not be directly or indirectly liable for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any third-party website or service.
9. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. EVWired, its operators and licensors disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement and course of performance.
EVWired does not warrant that the Service will be uninterrupted, error-free, secure or that defects will be corrected. The Content does not constitute professional financial, legal or purchasing advice. Vehicle specifications, prices, incentives and regulations change frequently and vary by market — always verify details with official manufacturer and government sources before making decisions. EVWired is not liable for any outcomes arising from decisions made based on the Content.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall EVWired, or its directors, employees, partners, agents, suppliers or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill or other intangible losses, arising out of or in connection with your access to, use of or inability to access or use the Service.
In no event shall the aggregate liability of EVWired for any claims arising out of or relating to these Terms or your use of the Service exceed one hundred US dollars (US $100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify and hold harmless EVWired and its officers, directors, employees, agents and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to reasonable attorneys' fees) arising from or related to (a) your use of or access to the Service; (b) your breach of these Terms; or (c) your violation of any rights of a third party.
12. Account suspension and termination
The Service does not currently require a user account for general access. However, if account features are introduced in the future, the following provisions will apply:
We reserve the right to suspend, disable or terminate your account and your access to the Service, without prior notice or liability, at our sole discretion, including without limitation if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately.
You may request deletion or deactivation of your account at any time by contacting [email protected]. Upon such a request, we will delete your account and associated personal data in accordance with our Privacy Policy, subject to legal retention requirements.
All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership, disclaimers, limitation of liability, indemnification and governing law provisions.
13. Changes to these terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will endeavor to provide at least 30 days' notice before any new terms take effect, by updating the "Last updated" date at the top of this page and posting a notice on the Site for material changes.
By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service. We encourage you to review these Terms periodically for the latest information.
14. Dispute resolution
Any dispute, claim or controversy arising out of or relating to these Terms, your use of the Service or your relationship with EVWired (collectively, a "Dispute") shall be resolved as follows:
a. Informal resolution
Before initiating formal proceedings, both parties shall first attempt in good faith to resolve any Dispute through informal negotiation. The complaining party must provide written notice of the Dispute to the other party, and both parties shall attempt to resolve the Dispute within sixty (60) days of such notice.
b. Binding arbitration
If a Dispute cannot be resolved through informal negotiation within sixty days, it shall be finally and exclusively resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its then-applicable consumer arbitration rules, except that either party may bring a claim in small claims court. Arbitration shall be conducted in English by a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
c. Class action waiver
You and EVWired agree that any arbitration shall be conducted on an individual basis only, and not as a class action or other representative proceeding. Both parties expressly waive any right to bring or participate in class actions or consolidated proceedings.
d. Equitable relief
Notwithstanding the foregoing, either party may at any time seek injunctive or other equitable relief from a court of competent jurisdiction to protect intellectual property or confidential information, without the need to first pursue arbitration.
15. Governing law and jurisdiction
These Terms and any Dispute arising from them shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict-of-law provisions.
Subject to the dispute resolution provisions of Section 14, the exclusive jurisdiction and venue for any litigation arising from or relating to these Terms or the Service shall be the state and federal courts located in the State of Delaware, United States (the "Designated Courts"). You and EVWired irrevocably submit to the exclusive jurisdiction of the Designated Courts and waive any objection based on inconvenient forum or improper venue.
16. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire and exclusive agreement between you and EVWired regarding the Service, and supersede and replace any prior or contemporaneous agreements, communications and understandings, whether oral or written, regarding the subject matter of these Terms.
17. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
18. Waiver
The failure of EVWired to enforce any right or provision of these Terms at any time shall not constitute a waiver of that right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of EVWired.
